이용약관

1. 총칙

1.1 목적

이 이용약관(이하 "약관")은 정유민(이하 "개발자")이 개발한 Forerunner 앱(이하 "서비스")을 이용하는 이용자(이하 "사용자")와 개발자 간의 서비스 이용에 관한 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

1.2 용어의 정의

• 서비스: 개발자가 제공하는 Forerunner 앱 및 관련 서비스 일체
• 사용자: 이 약관에 따라 서비스를 이용하는 자
• 건강 데이터: Apple 건강 앱에 저장된 걸음 수, 운동 기록, 마음 상태 데이터
• 사용 데이터: 앱 이용 행동 분석을 위한 익명화된 데이터

1.3 약관의 적용 및 개정

이 약관은 사용자가 서비스를 이용하는 시점부터 적용됩니다. 개발자는 약관을 개정할 수 있으며, 개정 시 7일 이상 사전에 공지합니다. 사용자가 개정된 약관에 동의하지 않을 경우 서비스 이용을 중단할 수 있습니다.

2. 서비스 이용계약

2.1 이용계약의 성립

이용계약은 사용자가 앱 설치 후 이 약관에 동의하고, 필요한 권한을 허용함으로써 성립됩니다. 별도의 회원가입 절차는 없으며, Apple 건강 앱 접근 권한 허용이 서비스 이용의 필수 조건입니다.

2.2 서비스 이용 조건

• iOS 기기에서만 이용 가능합니다.
• Apple 건강 앱이 설치되어 있어야 합니다.
• 건강 데이터 접근 권한을 허용해야 합니다.
• 앱 사용 분석을 위한 데이터 수집에 동의해야 합니다.

3. 서비스의 제공

3.1 서비스 내용

개발자는 다음과 같은 서비스를 제공합니다:

• Apple 건강 앱의 사용자 데이터를 활용한 건강 정보 시각화
• 운동 및 건강 관련 인사이트 제공
• 개인 맞춤형 건강 통계 및 분석
• 목표 설정 및 진행 상황 추적

3.2 서비스의 변경 및 중단

개발자는 서비스의 개선, 기술적 사유, 또는 기타 중대한 사유로 인해 서비스의 전부 또는 일부를 변경하거나 중단할 수 있습니다. 이 경우 사전에 공지하며, 사용자에게 불이익이 발생하지 않도록 노력합니다.

4. 개인정보 및 데이터 처리

4.1 건강 데이터 처리

• 사용자의 건강 데이터는 절대 외부 서버로 전송되지 않습니다.
• 모든 건강 데이터는 사용자 기기 내에서만 처리됩니다.
• 사용자가 Apple 건강 앱 접근 권한을 해제하면 즉시 데이터 접근이 중단됩니다.

4.2 사용 데이터 수집

앱 개선을 위해 익명화된 사용 행동 데이터(화면 전환, 버튼 클릭 등)가 Amplitude 분석 도구를 통해 수집될 수 있습니다. 이 데이터에는 건강 정보가 포함되지 않으며, 개인 식별이 불가능합니다.

5. 사용자의 권리와 의무

5.1 사용자의 권리

• 언제든지 Apple 건강 앱 접근 권한을 해제할 권리
• 서비스 이용을 중단할 권리
• 개인정보 처리에 대한 문의 및 요청할 권리

5.2 사용자의 의무

• 서비스를 선량한 목적으로만 이용할 의무
• 타인의 권리나 명예를 침해하지 않을 의무
• 관련 법령을 준수할 의무
• 서비스의 정상적인 운영을 방해하지 않을 의무

6. 서비스 이용의 제한

6.1 금지행위

사용자는 다음 행위를 해서는 안 됩니다:

• 서비스를 불법적인 목적으로 이용하는 행위
• 앱의 소스코드를 역분석, 역설계, 분해하는 행위
• 서비스의 보안 체계를 무력화하려는 행위
• 개발자나 제3자의 지적재산권을 침해하는 행위

7. 책임의 한계

7.1 서비스 이용에 대한 책임

사용자는 본인의 판단과 책임 하에 서비스를 이용합니다. 개발자는 사용자의 서비스 이용으로 발생한 손해에 대해 법령에서 정하는 경우를 제외하고는 책임을 지지 않습니다.

7.2 의료적 책임의 한계

본 서비스는 건강 정보의 시각화 및 분석을 위한 도구이며, 의료진의 진단이나 치료를 대체하지 않습니다. 건강상의 결정은 반드시 의료진과 상담 후 내리시기 바랍니다.

8. 지적재산권

서비스 및 서비스에 포함된 모든 콘텐츠, 상표, 저작물에 대한 지적재산권은 개발자에게 있습니다. 사용자는 개발자의 사전 승인 없이 이를 복제, 전송, 배포, 상업적으로 이용할 수 없습니다.

9. 분쟁 해결

9.1 준거법 및 관할법원

이 약관은 대한민국 법률에 따라 해석되며, 서비스 이용으로 발생한 분쟁은 관할 법원에서 해결합니다.

10. 기타

이 약관에서 정하지 않은 사항에 대해서는 관련 법령 또는 상관례에 따릅니다. 약관의 일부 조항이 무효로 판단되더라도 나머지 조항의 유효성에는 영향을 주지 않습니다.

1. General Provisions

1.1 Purpose

These Terms of Service (the "Terms") govern the rights, obligations, and responsibilities between users ("Users") and Yumin Jung (the "Developer") regarding the use of the Forerunner app (the "Service") developed by the Developer.

1.2 Definitions

• Service: The Forerunner app and all related services provided by the Developer
• User: Any individual who uses the Service in accordance with these Terms
• Health Data: Steps count, workout records, and mindfulness data stored in the Apple Health app
• Usage Data: Anonymized data collected for app usage behavior analysis

1.3 Application and Amendment of Terms

These Terms apply from the moment Users begin using the Service. The Developer may amend these Terms and will provide at least 7 days' advance notice of any changes. Users who do not agree to the amended Terms may discontinue using the Service.

2. Service Usage Agreement

2.1 Formation of Usage Agreement

The usage agreement is formed when Users install the app, agree to these Terms, and grant necessary permissions. No separate registration process is required, and granting Apple Health access permission is essential for service usage.

2.2 Service Usage Conditions

• Available only on iOS devices
• Apple Health app must be installed
• Health data access permission must be granted
• Consent to data collection for app usage analysis is required

3. Service Provision

3.1 Service Content

The Developer provides the following services:

• Health information visualization using Apple Health app's user data
• Exercise and health-related insights
• Personalized health statistics and analysis
• Goal setting and progress tracking

3.2 Service Changes and Suspension

The Developer may modify or suspend all or part of the Service due to improvements, technical reasons, or other significant causes. In such cases, advance notice will be provided, and efforts will be made to minimize user inconvenience.

4. Personal Information and Data Processing

4.1 Health Data Processing

• User health data is never transmitted to external servers
• All health data is processed exclusively within the user's device
• Data access ceases immediately when users revoke Apple Health access permissions

4.2 Usage Data Collection

Anonymized usage behavior data (screen transitions, button clicks, etc.) may be collected via the Amplitude analytics tool for app improvement purposes. This data does not include health information and cannot identify individuals.

5. User Rights and Obligations

5.1 User Rights

• Right to revoke Apple Health access permissions at any time
• Right to discontinue service usage
• Right to inquire about and request personal information processing

5.2 User Obligations

• Obligation to use the Service for legitimate purposes only
• Obligation not to infringe upon others' rights or reputation
• Obligation to comply with relevant laws and regulations
• Obligation not to interfere with normal service operations

6. Service Usage Restrictions

6.1 Prohibited Activities

Users must not engage in the following activities:

• Using the Service for illegal purposes
• Reverse engineering, decompiling, or disassembling the app's source code
• Attempting to compromise the Service's security systems
• Infringing upon the intellectual property rights of the Developer or third parties

7. Limitation of Liability

7.1 Responsibility for Service Usage

Users use the Service at their own judgment and risk. The Developer is not liable for damages arising from users' service usage, except as provided by law.

7.2 Limitation of Medical Liability

This Service is a tool for health information visualization and analysis and does not replace professional medical diagnosis or treatment. Health-related decisions should always be made in consultation with healthcare professionals.

8. Intellectual Property Rights

All intellectual property rights to the Service and all content, trademarks, and works included in the Service belong to the Developer. Users may not reproduce, transmit, distribute, or commercially use these without the Developer's prior approval.

9. Dispute Resolution

9.1 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea, and disputes arising from service usage shall be resolved in the competent courts.

10. Miscellaneous
